More details have surfaced regarding the alleged incident that took place following extreme metal band Decapitated's August 31 show in Spokane, Washington which eventually landed all four members of the group in a Los Angeles County jail.
According to court documents obtained by The Spokesman-Review, the alleged victim told police that her and a friend were invited to the band's tour bus to have drinks after the show. Not long thereafter, one of the women "described being excited to be on the bus, and then one of the band members began grabbing her breasts," court documents say. "He was later identified as the drummer, Michal Lysejko." The woman went on to say that she "was uncomfortable and said the band members began speaking to each other in Polish." She explained that the "vibe" in the bus had shifted, and "one of the members began looking at them like they were prey."
The woman said she looked at her friend "to signal they needed to get out of there." She then attempted to use the bathroom and was followed by Decapitated vocalist Rafal Piotrowski, court documents say. The woman claims that Piotrowski then began kissing her and started to undo her belt. She "attempted to push Piotrowski away but he grabbed her arm and spun her around to where she was facing the sink and mirror in the bathroom. She saw in the mirror and out of the corner of her eye each of the band members taking turns raping her."
The other woman told authorities that she watched as the band members raped her friend. Piotrowski then allegedly asked her to perform oral sex on him, and was "pushed to the ground and received bruises to her knees and shins" when she refused.
Shortly after exiting the tour bus and driving away, the friend was pulled over by police on suspicion of driving under the influence. While detained in a police car, the friend used her cellphone to call the other woman, who reported the rape.
The alleged victim "described her body as feeling broken," according to court documents. "After an unknown amount of time," she told police, "Waclaw [Kieltyka] helped her put her clothing on and carried her out of the bus with another male."
The woman was eventually taken to Providence Holy Family Hospital for an assault examination. Detectives noted she had "significant bruising to her upper arms consistent with being restrained" and "small abrasions to her knuckles that were scabbed over."
Upon interview late last week by the Los Angeles County Sheriff's Office, Lysejko "made no comment other than he did not know who the girls were" upon being presented a photo of the pair. Lysejko refused to talk further without a translator.
Meanwhile, guitarist Waclaw Kieltyka told detectives he saw both Piotrowski and bass player Hubert Wiecek engaged in a sex act with the woman in the bathroom. Piotrowski "admitted there was a party on the bus and (the women) were present" before requesting an attorney and a translator. Kieltyka provided a DNA sample, but Piotrowski refused to do so.
Wiecek admitted the women had been on the bus, but claimed that he "sat on the couch and did not see what was going on." He also requested a translator and refused to give a DNA sample.
All four members remain in jail facing extradition to Spokane. The band's attorney, Steve Graham, said Monday that, "Decapitated plan to fully fight the allegations that are brought against them, and we are fully confident that the other side of this story will be heard."
